1. Acceptance of Terms

By accessing or using ListingLift ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

These terms form a binding agreement between you and ListingLift. "You" means any individual or business using the Service.

2. What ListingLift Does

ListingLift is an AI-powered SEO tool for Etsy sellers. It analyzes your shop and listings, then generates optimized titles, tags, and descriptions intended to improve search visibility on Etsy.

We offer two service tiers:

  • Monthly Subscription — Ongoing AI audits, recommendations, and access to the guarantee program described below.
  • Done-For-You (DFY) — $99 one-time — We deliver up to 10 AI-optimized listing titles, tags, and descriptions for your shop.

3. The "+$500 Sales Lift" Guarantee — How It Works

We stand behind our product. If your Etsy shop does not see at least $500 more in monthly sales after using ListingLift, you can request a full refund of your most recent monthly subscription fee.

To qualify, every one of the following must be true:

  1. You completed a full ListingLift audit of your shop.
  2. You implemented all AI-generated recommendations within 7 days of receiving them.
  3. You kept those optimized listings live and unchanged for at least 30 consecutive days.
  4. You provided verifiable Etsy shop stats — either screenshots from your Etsy dashboard or a CSV export — showing your baseline sales before starting and your sales after the 30-day period.
  5. You submitted your refund request within 45 days of your subscription start date.

The guarantee covers only the monthly subscription fee you paid — not any theoretical lost sales, lost revenue, or opportunity costs.

4. Guarantee Exclusions — When It Does Not Apply

The guarantee does not apply in any of these situations:

  • Your Etsy shop is fewer than 90 days old at the time you subscribe.
  • Your shop has fewer than 10 active listings.
  • Your shop sells items that violate Etsy's policies or are otherwise prohibited.
  • Your sales decline is caused by external factors outside our control — including Etsy algorithm changes, Etsy shop suspensions or restrictions, seasonal sales downturns, or broader market conditions.
  • You did not implement all recommendations, or you modified or removed optimized listings before the 30-day period ended.
  • You cannot provide verifiable before/after Etsy stats as described in Section 3.
  • You request a refund outside the 45-day window.

5. How to Submit a Guarantee Claim

To request a refund under the guarantee, email us at support@richgibbs.dev with:

  • Subject line: Guarantee Claim
  • Your Etsy shop URL
  • Your before/after Etsy stats as screenshots or a CSV export
  • A written confirmation that you implemented all recommendations within 7 days and kept listings unchanged for 30 days

We will review and process all valid claims within 14 business days of receiving complete documentation.

Each user is limited to one guarantee claim per 12-month period.

6. Done-For-You (DFY) Service Terms

The $99 DFY service is a one-time purchase. You receive up to 10 AI-optimized listing titles, tags, and descriptions delivered to you directly.

DFY refund eligibility is separate from the monthly subscription guarantee. If you implement all delivered DFY recommendations within 7 days, keep those listings live and materially unchanged for 60 consecutive days, and provide verifiable Etsy before/after stats showing that the optimized listings did not produce at least $500 in net-new monthly sales during that window, you may request a refund of the $99 DFY fee.

Valid DFY refund requests must be submitted within 75 days of purchase to support@richgibbs.dev with your order receipt, Etsy shop URL, implementation date, and before/after Etsy stats. We will review complete DFY refund requests within 14 business days. The DFY guarantee is limited to the $99 DFY fee actually paid and one free optimization pass on up to 10 additional listings; it does not cover lost revenue, lost profit, Etsy fees, ad spend, or other consequential losses.

If you do not implement the delivered recommendations, cannot provide verifiable before/after Etsy stats, change or remove the optimized listings during the 60-day window, or request outside the 75-day window, the DFY purchase is non-refundable after delivery.

7. Subscription Billing and Cancellation

Subscriptions are billed monthly. You can cancel at any time — there are no cancellation fees and no long-term commitments.

When you cancel, your access continues through the end of the billing period you have already paid for. We do not offer partial-month refunds, except as part of a valid guarantee claim processed under Sections 3–5.

8. AI-Generated Content — Your Responsibility

All titles, tags, and descriptions generated by ListingLift are AI-produced suggestions. They are starting points, not final copy.

You are solely responsible for reviewing, editing, and publishing any AI-generated content to your Etsy listings. You must ensure that what you publish complies with Etsy's policies before making it live.

ListingLift is not liable for any Etsy policy violations, listing removals, account warnings, or shop suspensions that result from content you choose to publish.

9. Etsy Disclaimer — We Are Not Etsy

ListingLift is an independent service and is not affiliated with, endorsed by, or officially connected to Etsy, Inc. in any way.

Etsy controls its own search algorithm and may change it at any time without notice. Those changes can affect your listing visibility and sales in ways that are completely outside our control.

We make no guarantee that Etsy will rank your listings higher, show them more often, or that any specific result will follow from using our service.

10. Limitation of Liability

ListingLift's total liability to you under any claim — whether in contract, tort, or otherwise — is capped at the total amount you paid us in the 30 days immediately before the claim arose.

We are not liable for any consequential, indirect, incidental, special, or punitive damages. This includes but is not limited to lost revenue, lost profits, lost sales, or business interruption — regardless of whether we were advised such damages were possible.

11. User Accounts

You are responsible for keeping your account credentials confidential. All activity that occurs under your account is your responsibility. If you suspect unauthorized access, contact us immediately at support@richgibbs.dev.

12. Acceptable Use

You agree to use ListingLift only for lawful purposes. You may not use the Service to violate any laws, infringe on anyone's intellectual property, or attempt to reverse-engineer, scrape, or disrupt the platform.

We reserve the right to suspend or terminate accounts that misuse the Service.

13. Intellectual Property

ListingLift owns all rights to the platform, software, branding, and underlying systems. The AI-generated content delivered to you is yours to use — subject to the responsibilities described in Section 8.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of [STATE], USA, without regard to conflict of law principles.

Any dispute arising from or relating to these Terms or the Service will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration takes place on an individual basis — class action lawsuits and class-wide arbitration are not permitted.

Nothing in this section prevents either party from seeking emergency injunctive relief from a court where necessary.

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will email you at least 30 days before the changes take effect. Continued use of the Service after that date means you accept the updated Terms.

Minor updates (like fixing typos or clarifying existing language) may take effect immediately.
